Terms & Conditions

Meister Creative reserves the right to change or modify this Agreement, and any policy or guideline incorporated by reference at any time at its sole discretion.

You (referred to as “Customer”) accept our Terms of Service, detailed herein, upon engaging our services and having paid your deposit. You agree that you’ve reviewed and understand the content within our website and that has been presented during calls and/or onboarding on how our service works and our scope.

​

Any changes or modification will be posted by Meister Creative to www.meistercreative.au/terms and become effective upon posting of the revisions on this document.

​

You are responsible for regularly reviewing the Site to obtain timely notice of such changes or modifications. Your continued use of the Services following Meister Creative posting of any changes or modifications will constitute your acceptance of such changes or modifications. IF YOU DO NOT AGREE TO THE TERMS OF ANY MODIFICATION, DO NOT CONTINUE TO USE THE SERVICES AND IMMEDIATELY PROVIDE NOTICE OF CANCELLATION OF THIS AGREEMENT.

Use

If you have agreed to a monthly subscription service your subscription and any add-ons will automatically renew at the end of the applicable subscription period. Meister Creative works on a variety of packages which include monthly delivery of "Credits" content. Turnaround times will vary dependant on your agreed upload schedule. Please refer to your individual contract to ensure time frames are met.

Single productions that Meister Creative have determined to fall outside of the scope of our Credit services, such as documentary, trailer or promotional production or edits, will have individual contract arrangements for the delivery of that content.

Service Description

Your team will only be assigned once you have submitted your first Video Request and completed a customer onboarding session. Please do this as soon as possible to avoid any delays since your account will remain unassigned but active until your first Video Request is received. We will follow up but the onus is on you to submit the Video Request.

A Project Manager will be assigned to your account. They will be responsible for managing and assigning editors to work on your projects. To maximize efficiencies in the workflow the team will work on your projects at an agreed schedule. To maintain this schedule you are required to upload your raw content at the set time agreed upon in your contract. Reviews will be sent as soon as possible and feedback from you will be actioned within 24 business hours.

Meister Creative uses Adobe Premiere Pro as our editing software of choice. You will therefore need to provide any assets you wish the Video Editor to use to be compatible with Adobe Premiere Pro. If you require working files we can only provide Adobe Premiere Pro project files.

​

Meister Creative's production resources operate in the AEST (GMT+10) time zone with work hours being from 9:00-17:00. Your team will work on your projects during your plan’s allotted work schedule. Your team may not always be available to reply beyond working hours however they will respond as soon as possible.

Hours of Operation

Our team operates every Mondays to Fridays 9 pm to 5pm AEST (GMT+10).

We take a company-wide break for Christmas and New Year. All clients receive advanced notice of the exact days and dates we take off as the break nears.

​

Our team also observes public holidays in their local areas. If this will affect your content delivery you will be notified in advance.

Credits

Meister Creative operates it's standard editing packages for social media on "Credits". You can pre-purchase Credits as you require or sign up for a subscription with ongoing monthly credit packs.

​

"Social Media Reels" and "Advanced Long Form"

1 Credit is equal to 1 minute of edited content. These edits may include stock footage, images, music, animated graphics and subtitles. Examples of these edits are reels for Instagram or TikTok or edits for YouTube.

​

"Basic Long Form"

2 Credits is equal to 1 minute of edited content. Basic long form requires no stock video or images, no music or advanced graphics editing. Examples include of basic long form include adding pre-made title animations to a podcast episode. Edits maximum 2 hours.

​

The cost of the Credits is the total cost including the technology, tools, systems, and processes required by Meister Creative to provide the service. Credits are not based on days or hours and no billing adjustment or refund is due if you have not provided the adequate amount of raw footage to complete your Credit amount.

​

Credits last for a 30 day calendar period. Credits not used in this period can be rolled over into the following 30 day period, after which they are void and additional credits must be purchased.

​

If you are working with Meister Creative outside the scope of our standard Credits packs, you will be presented with a budget proposal of which terms of service and delivery are determined and agreed upon by both parties at that time.

Cancellation

You may cancel your Credit Pack with Meister Creative at any time before the end of the then-current subscription period. To cancel your retainer please email: support@meistercreative.au

Upon cancellation, you will continue to have access to the Meister Creative services and your files through the end of your paid billing term. Access to your account files requires an active subscription. Cancelled accounts will not have access to their files once their billing term has ended.

Payments and Refunds

Credits payments are non-refundable and we do not provide refunds or credits for any partial subscription periods.

​

For productions that require a deposit be paid upfront, that deposit is non-refundable. Subsequent payment milestones must be met to continue with the production schedule and once processed each milestone payment is non-refundable.

​

It is not Meister Creative's policy to ask for total payment upfront outside of our Credits offers. For alternate productions if you pay for a production in total upfront, a minimum 30% is non-refundable and it is at Meister Creative's discretion to issue any further refunds.

​

You further agree that, upon registering for the services through the Site, you authorize Meister Creative to charge your method of payment (e.g. credit card) for the fee on each anniversary of your registration date, based upon your billing frequency (e.g. monthly, quarterly, annually). Your account and access to the services provided via the site may be suspended in the event of non-payment of applicable fees.

You represent and warrant to Meister Creative that such payment information is accurate and that you are authorized to use the payment instrument. You will promptly update your account information with any changes (for example, a change in your billing address or credit card expiration date) that may occur.

​

Meister Creative may change its fees from time to time by posting the changes on the Site with 5 days prior notice, but with no advance notice required for temporary promotions or reductions in fees. You, the client are responsible to use Meister Creative after payment.

Limitations and Abuse of Service

If we find that you are not in alignment with our model, sharing accounts/logins, violate our core values, or are abusing our services or team in any way, we reserve the right to cancel your account.

Meister Creative does not accept requests outside of its scope of services and therefore reserves the right to decline or cancel a project at it's discretion.

​

Abuse of our team or service providers is not tolerated and will result in immediate cancellation of your subscription or project.

Ownership of Content

Customer maintains the ownership rights in any User Content that such Customer submits to the site and the finished product Meister Creative produces, unless otherwise authorised. Meister Creative reserves the right to use the finished product or raw materials they have created in promotional material. Raw material such as images or footage that Meister Creative have produced remains their copyright.

Grant of Limited Rights

By submitting a Task to Meister Creative, the Customer gives us the rights to User Content to the extent necessary to complete the Task. Each Customer authorizes us to retain archival copies of all User Content that such Customer has submitted.

By default, you agree to provide Meister Creative with a non-exclusive right and license to publish your work in our portfolio, website logo block, social media, email, or other communication efforts. If you would like to revoke this right, please notify our team in writing to support@meistercreative.au

Revisions

Meister Creative accepts two rounds of reasonable revisions per project. Additional revisions may be charged at an hourly rate. We will do our best to deliver content without need of revisions and accept additional revisions to mistakes deemed to be out fault. The discretion of these terms is with Meister Creative. Your right to use the Meister Creative services shall terminate upon your breach of any term of this Agreement.

Limitation of Liability

We will not be liable to you or any third party in any event for any loss (financially or otherwise) or any damages arising from or relating to this Agreement. You acknowledge and agree that your use of this site and our services is at your own discretion and risk. BECAUSE SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, OR LIMITATIONS OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THESE LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT SHALL THE TOTAL LIABILITY OF Meister Creative UNDER THIS AGREEMENT EXCEED FIFTY DOLLARS ($50), REGARDLESS OF THE CAUSE OF ACTION, IN TORT, CONTRACT, OR OTHERWISE.

Definitions

Business day – Meister Creative operates in the East Australia time zone. Monday – Friday from 9 am – 5 pm GMT +10.

Digital Millennium Copyright Act (DMCA). In the event materials are made available to this Site by third parties not within our control (ie: stock footage, creative commons license), we are under no obligation to, and do not, scan such content for the inclusion of illegal or impermissible content. However, we respect the copyright interests of others. It is our policy not to permit materials known by us to infringe another party’s copyright to remain on the Site. If you believe any materials on the Site infringe a copyright, you should provide us with written notice that at a minimum contains:

​

– A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

​

-Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

​

-Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;

​

-Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted;


-A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;

​

– and A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

It is our policy to terminate relationships regarding content with third parties who repeatedly infringe the copyrights of others.

​

Governing law: Any claim relating to Meister Creative's web site shall be governed by the laws of the State of Queensland, Australia without regard to its conflict of law provisions.
